1. The agreement

These terms are a contract between Claritute (Angelo Hanna, sole trader) and you, the parent or guardian who opens or authorises an account. By creating an account, ticking the consent box, or paying for a plan, you agree to these terms and the Privacy Policy. Children use Claritute under your authority: account holders under 18 may use the platform only with the consent and under the general supervision of a parent/guardian, who is responsible for the account and is our contracting party. We may treat instructions from the linked parent account as authoritative for a child's account.

2. What Claritute provides

The learning platform — NSW-syllabus maths lessons (Years 3–12), practice, Gap Finder diagnostics, a practice-exam generator, progress tracking, the AI study assistant, and a parent account with full visibility. Plus 1:1 tutoring where booked, delivered by Angelo Hanna (registered NSW teacher, WWCC held) or an assigned tutor with a verified WWCC. The platform is a study aid, not a school: we don't guarantee particular marks, and content should be used alongside your child's schooling. Claritute is independent and not endorsed by NESA or the NSW Department of Education.

3. Accounts

Give accurate details and keep logins secure. One login per person — each child gets their own account so their learning data stays meaningful. We may suspend accounts that are compromised, abusive or in breach of these terms. You can close your account at any time (§6, §11).

4. Plans, billing and the free trial

Subscriptions renew automatically — monthly or yearly per the plan you chose — until cancelled. Prices are shown at checkout in AUD; we are not currently registered for GST, so prices don't include GST while that remains the case. Free trial: where a plan includes one, your card is charged only when the trial ends — cancel before then and you pay nothing. Cancelling: any time via Manage plan or by email; cancellation stops future renewals and access runs to the end of the paid period. Price changes apply from your next renewal with notice. Failed payments may pause access until payment succeeds.

5. Refunds

14-day no-questions refund on your first subscription payment for a plan — tell us within 14 days of the charge and we refund it in full. Renewals aren't refunded for simple non-use, but talk to us — we'd rather fix the problem. Nothing in these terms limits your rights under the Australian Consumer Law. Our services come with guarantees that cannot be excluded — including due care and skill and fitness for purpose — and if we fail one, you're entitled to the ACL's remedies. Our refund policy operates in addition to those rights, not instead of them.

6. Tutoring sessions

Sessions and packages are paid via Stripe (or invoice where agreed); custom per-student rates may apply where agreed with you. Rescheduling: 24+ hours' notice moves a session free; less notice or a no-show may forfeit the session (first genuine emergency — we'll rebook it). If we cancel, you choose a rebooked session or a refund. In-person sessions happen at the agreed address with a parent/guardian or responsible adult present at the premises. Online sessions run on the agreed platform and a parent may sit in at any time. Child safety: every tutor holds a verified NSW WWCC before any student contact; any concern is acted on immediately.

7. Acceptable use

Don't share, resell, scrape or bulk-download the learning materials; access other users' data; upload unlawful or harmful content; misuse the AI assistant; or interfere with the service. Serious or repeated breaches may lead to suspension, with a refund of any unused paid period where the suspension isn't due to serious wrongdoing.

8. Intellectual property

All learning materials on Claritute are owned by or licensed to Claritute. Your family gets a personal, non-transferable licence to use them for your child's own learning while the account is active; schools receive the licence in their school agreement. You keep ownership of anything you upload and grant us permission to store and use it solely to provide the service. Some practice-exam questions are drawn from past NSW school papers with attribution, used for educational practice.

9. The AI study assistant and photo tutor

The assistant (including the photo tutor, where enabled — photograph a problem and be coached through it) is an automated study aid: it can make mistakes and isn't a substitute for a teacher. It's designed to guide rather than just give answers, and conversations are visible to the linked parent. Photos must be of maths problems only — no people. See the Privacy Policy §7 for exactly what data these features process and how photos are deleted.

10. Liability

To the extent permitted by law — and always subject to the Australian Consumer Law consumer guarantees, which we do not exclude or limit: we're liable for what we control (providing the platform and sessions with due care and skill, and our own negligence); we're not liable for things outside our reasonable control (your internet or device, third-party outages) or for indirect losses, to the extent the law allows such limits; and for loss not covered by a non-excludable right, our total liability is capped at the greater of the amount you paid us in the previous 12 months and $200, again only so far as the law permits. Nothing here excludes liability that cannot lawfully be excluded, including for personal injury caused by negligence.

11. Ending the agreement

You can stop at any time — cancel renewals and/or ask us to delete the account (deletion is permanent; Privacy Policy §10–11). We can end or suspend an account for serious breach, or if we wind down the service — in which case we refund the unused portion of anything prepaid.

12. General

These terms are governed by the laws of New South Wales, Australia, and disputes belong to the courts of NSW (this doesn't displace NCAT or your ACL remedies). If part is unenforceable, the rest still applies. We may update these terms; material changes are notified by email and posted with a new version number, and continued use after the effective date is acceptance. If Claritute incorporates (e.g. becomes a Pty Ltd), the agreement continues with the new entity on the same terms and we'll notify you.
